Awards of Costs in Pro Bono Cases

The Legal Services Act has paved the way for awards of costs to be made in cases won by litigants who are supported by lawyers acting pro bono. The funds will be paid to a new charity, the Access to Justice Foundation. The rules will take effect in late 2008. Costs will only be awarded under these rules if they would have been awarded had the lawyer been paid.

FRU’s opinion is included in the attached article in the Law Society’s Gazette.
